Today in the Indicator HR and Employment Law podcast, we're discussing the Information Commissioner's Office's consultation on draft guidance on automated decision-making, including profiling. This draft guidance serves as an update to the existing guidance on automated decision making and profiling to take account of the Data (Use and Access) Act 2025. The consultation closes on 29 May 2026. Regulations have also been made which will require the Information Commissioner to prepare a code of practice on the processing of personal data and using AI and automated decision making. This new code will build on the current non-statutory guidance on AI. There is no time scale as to when this code will be published and undoubtedly there will be a consultation on a draft code in due course. We will keep you up to date with further developments. Specifically with regard to use of AI and automated decision making in recruitment and selection, the ICO has published an update on its work on the fair and responsible use of automation in recruitment, which sets out its expectations for any organisation using automated decision making for hiring decisions. The ICO also plans to update its draft guidance on the use of automated decision-making and profiling in recruitment and selection, which is part of the draft guidance on recruitment and selection in 2026.
