Today in the Indicator HR and Employment Law podcast, we're discussing the Information Commissioner's Office's update on its work on the fair and responsible use of automation in recruitment, which sets out its expectations for organisations using automated decision-making for hiring decisions. The ICO's key finding is that many employers engaging in automated recruitment are likely relying on solely automated decisions as part of this process, which places these decisions within the scope of the provisions on solely automated decision-making in the UK General Data Protection Regulation. For this reason, a greater range of safeguards will need to apply than the evidence suggests are currently in place. The findings also suggest that employers must improve their transparency measures to ensure they adequately inform candidates about the use of automated decision-making, including any solely automated decisions in the recruitment process. Where employers include meaningful human involvement in their recruitment processes, they must ensure that it is applied consistently to all candidates within a hiring stage to ensure fair treatment and compliance. And employers should expand and adopt good practice in monitoring for fairness and bias. These requirements are discussed further in the report, together with practical examples. The ICO also plans to update its draft guidance on the use of automated decision making and profiling in recruitment and selection, which is part of the draft guidance on recruitment and selection in 2026.
