In this case, the EAT has considered whether in circumstances where an employee meets the terms for entitlement to a discretionary bonus, the employer is able to retrospectively “move the goalposts” to reduce the amount payable under the discretionary bonus scheme and, if it is not, whether an employee would then be entitled to claim the unpaid bonus as an unlawful deduction from wages.
